I have purchased a handful of games from New Egg. They have all been brand new unopened copies. I know when it comes to hardware, that New Egg will always label used items as used and refurbished items as being refurbished. This does come from a third party vendor, I think, so I'm not positive that the same applies here but I would guess it does.
